By downloading, installing, or using the SecondChimes iOS application ("App") or accessing our website, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App or services.

2. Description of Service

SecondChimes provides an iOS application and related services. The App is designed to operate entirely on your device without collecting or transmitting personal data. We reserve the right to modify, suspend, or discontinue the App or any features at any time without notice.

3. License to Use App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on iOS devices that you own or control. This license is for personal, non-commercial use only.

4. Apple App Store Terms

By downloading our App from the Apple App Store, you also agree to Apple's Terms of Service and any applicable Apple policies. These Terms are in addition to, and do not replace, Apple's terms. In case of conflict between these Terms and Apple's terms regarding use of the App Store, Apple's terms prevail.

You acknowledge that:

  • These Terms are between you and SecondChimes, not Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product warranties or claims
  • Apple is not responsible for addressing any third-party claims relating to the App
  • Apple and its subsidiaries are third-party beneficiaries of these Terms

5. User Obligations

By using our App and services, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Not reverse engineer, decompile, or disassemble the App
  • Not modify, adapt, or create derivative works from the App
  • Not interfere with or disrupt the App's functionality
  • Not use the App to violate any applicable laws or regulations
  • Not remove or alter any proprietary notices from the App

6. Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of SecondChimes and its licensors. The App is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

8. Updates and Changes

We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECONDCHIMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or alteration of your device or data
  • Any bugs, viruses, or other harmful code in the App
  • Any errors or omissions in any content

In no event shall our total liability exceed the amount you paid for the App in the twelve months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless SecondChimes and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your violation of these Terms or your use of the App.

12. Termination

We may terminate or suspend your right to use the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SecondChimes regarding the use of our App and services.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes indicates acceptance of the modified Terms.
